1. Acceptance of Terms

By accessing or using the Mitis application ("Service"), whether through our website, the Apple App Store, Google Play Store, or any other platform, you agree to be bound by these Terms of Use. Mitis is developed and operated by Neosolus, a company registered in France.

If you do not agree to these terms, do not use the Service.

2. Description of Service

Mitis is a social platform for sharing moods and emotional states with friends, family, and colleagues through private "Circles." The Service enables users to:

• Share their current mood using Plutchik's emotional framework.
• View moods of people in their circles.
• Send support and reactions without words.
• Create and manage private circles for different groups.

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Eligibility

You must be at least 13 years old (or 16 in certain jurisdictions within the EU) to use Mitis. By using the Service, you represent that you meet this age requirement.

4. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Promptly update any information that becomes inaccurate.
• Accept responsibility for all activities under your account.

5. User Conduct

You are responsible for your use of the Service. You agree NOT to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful.
• Impersonate others or misrepresent your identity or affiliation.
• Share private or personal information of others without their explicit consent.
• Use the Service for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to the Service or its systems.
• Interfere with or disrupt the Service or servers.
• Use automated means (bots, scrapers) to access the Service without permission.
• Violate any applicable laws or regulations.

6. User Generated Content & Moderation

You retain ownership of content you create on Mitis, but you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content to provide the Service.

Reporting and Enforcement:

• Users can report inappropriate content or behavior directly within the app.
• We review all reports within 24 hours.
• Violations may result in content removal, account suspension, or permanent ban.
• We reserve the right to remove any content at our sole discretion.

7. App Store Terms

If you download Mitis from the Apple App Store or Google Play Store, you also agree to their respective terms of service:

• Apple: These Terms are between you and Neosolus only, not Apple. Apple has no obligation to provide maintenance or support.
• Google: You acknowledge that Google has no responsibility for the app or its content.

Both Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

8. Intellectual Property

The Mitis name, logo, and all related trademarks, service marks, and trade names are the property of Neosolus. The Service and its original content (excluding user content) are protected by copyright, trademark, and other intellectual property laws.

9. Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms.
• Violation of our community guidelines.
• Request by law enforcement or government agencies.
• Extended periods of inactivity.

You may also delete your account at any time through the app settings.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEOSOLUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, RESULTING FROM:

• Your use or inability to use the Service.
• Any unauthorized access to your account or data.
• Conduct or content of any third party on the Service.
• Any content obtained from the Service.

12. Indemnification

You agree to indemnify and hold harmless Neosolus from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Nanterre, France.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes constitutes acceptance of the new Terms.
